This document is an electronic record in terms of the Information Technology Act, 2000, and rules thereunder as applicable, and the amended provisions pertaining to electronic records in various statutes as amended by the Information Technology Act, 2000. This electronic record is generated by a computer system and does not require any physical or digital signatures.

This document is published in accordance with the provisions of Rule 3 (1) of the Information Technology (Intermediaries guidelines) Rules, 2011, that require publishing the rules and regulations, privacy policy, and Terms of Use for access or usage of domain name [www.jiiapp.com] ("Website"), including the related mobile site and mobile application (hereinafter referred to as "Platform").

The Platform is owned by Jii App, a company incorporated under the Companies Act, 1956, with its registered office at H.No.419, Khalchawada, Gaothan, Sanquelim-Goa 403505, and its branch office at Shiv Towers, 412, Patto, Panaji-Goa 403001 (hereinafter referred to as "Jii").

Your use of the Platform and services and tools are governed by the following terms and conditions ("Terms of Use") as applicable to the Platform, including the applicable policies which are incorporated herein by way of reference. If You transact on the Platform, You shall be subject to the policies that are applicable to the Platform for such transactions. By mere use of the Platform, You shall be contracting with Jii App, and these terms and conditions, including the policies, constitute Your binding obligations with Jii.

For the purpose of these Terms of Use, wherever the context so requires, "You" or "User" shall mean any natural or legal person who has agreed to become a buyer on the Platform by providing Registration Data while registering on the Platform as a Registered User using the computer systems. Jii allows the User to surf the Platform or make purchases without registering on the Platform. The terms "We", "Us", "Our" shall mean Jii App.

ACCESSING, BROWSING, OR OTHERWISE USING THE SITE INDICATES YOUR AGREEMENT TO ALL THE TERMS AND CONDITIONS UNDER THESE TERMS OF USE, SO PLEASE READ THE TERMS OF USE CAREFULLY BEFORE PROCEEDING.

Amendment to User(s) Agreement

Jii App reserves the right to change, modify, amend, or update the Agreement from time to time. Such amended provisions of the Agreement shall be effective immediately upon being posted on the Platform.

Website - Merely A Venue/Platform

The Platform acts as a match-making platform for User(s) to negotiate and interact with other User(s) for entering into negotiations in respect thereof for the sale or supply of goods or services.

Jii does not control and is not liable in respect of or responsible for the quality, safety, genuineness, lawfulness, or availability of the products or services offered for sale on the Platform.

Membership Eligibility

Transactions on the Platform are available only to persons who can form legally binding contracts under the Indian Contract Act, 1872. If you are a minor, i.e., under the age of 18 years, you may use the Platform only under the supervision and prior consent of a parent or legal guardian.

Every manufacturer and dealer will have to pay to access the Platform. Customers and workers do not have to pay to access the Platform; however, if a customer wishes to access the services of a worker, they will have to pay for such access.

Your Account and Registration Obligations

If you use the Platform, you shall be responsible for maintaining the confidentiality of your Display Name and Password, and you shall be responsible for all activities that occur under your Display Name and Password.

Your email address is treated as your primary identifier on the Platform. It is your responsibility to ensure that your email address is up-to-date on the Platform at all times.

You must maintain the confidentiality of your account information and for all activities that occur under your account. You must not share your login details with any other person.

Posting Your Content on the Platform

Some content displayed on the Platform is provided or posted by third parties. Users can post their content on certain sections or services of the Platform using the self-help submit and edit tools provided at those sections.

Users solely represent, warrant, and agree to:

(a) Provide Jii with true, accurate, current, and complete information to be displayed on the Platform;

(b) Maintain and promptly amend all information provided on the Platform to keep it true, accurate, current, and complete.

Interaction Between Users

Jii provides an online platform to facilitate interaction between manufacturers, dealers, workers, and customers. Jii does not represent the seller, buyer, manufacturer, or worker in transactions.

Users agree to fully assume the risks of any transactions ("Transaction Risks") conducted on the basis of any content, information, or any other material provided on the Platform.

Dealers or workers may contact manufacturers through their mobile numbers provided in the chat on the Platform.

Payment

All payments made against the purchases/services on the Platform by you shall be compulsorily in Indian Rupees acceptable in the Republic of India.

The Jii App currently provides only a cash-on-delivery payment option for customer orders.

Charges

Jii may charge a nominal fee for browsing and accessing services on the Platform. Jii reserves the right to change its Fee Policy from time to time.

Refund and Cancellation

At Jii, we do not provide refund or cancellation policies on internal or external payments. All payments made to Jii are final and non-refundable.

Intellectual Property Rights

Jii App is the sole owner and lawful licensee of all the rights to the platform and its content ("Platform Content"). All title, ownership, and intellectual property rights in the Platform and the Platform Content shall remain with Jii App, its affiliates, or licensors.

Trademark

"Jii App" and related icons and logos are registered trademarks or trademarks or service marks of Jii App in various jurisdictions.

Copyright

All Platform Content, including Platform Information, is copyrighted to Jii App, excluding any third-party content and any links to any third-party websites.

Privacy

We view the protection of your privacy as a very important principle. We store and process your information on computers that may be protected by physical as well as reasonable technological security measures.

Limitation of Liability/Disclaimer

The features and services on the Jii App Platform are provided on an "as is" and "as available" basis. Jii App hereby expressly disclaims any and all warranties, express or implied.

Indemnity

You shall indemnify and hold harmless Jii App, its owner, licensee, affiliates, subsidiaries, group companies, and their respective officers, directors, agents, and employees from any claim, demand, or actions.

Termination

Jii App reserves the right to terminate access to certain areas or features of the Platform at any time without assigning any reason and with or without notice.

Governing Law And Dispute Resolutions

This Agreement and the Privacy Policy shall be governed in all respects by the laws of Indian Territory. The parties hereby submit to the exclusive jurisdiction of the courts of Goa, India.

Miscellaneous

Headings for any section of the Agreement are for reference purposes only. If any provision of this Agreement is held to be invalid or unenforceable, the remaining provisions shall be enforced.
